Istilah Teori Hukum

Di Belanda, digunakan 2 (dua) istilah yaitu rechtswetenschap dan rechtstheorie. Istilah rechtswetenschap dalam arti sempit disebut dogmatik hukum. Tugasnya adalah melakukan deskripsi, sistematisasi, eksplanasi hukum positif. Rechtswetenschap dalam arti luas meliputi keseluruhan lapisan hukum. Lapisan ilmu hukum itu meliputi :

- dogmatik hukum

- teori hukum

- filsafat hukum

Adapun istilah rechtstheorie juga digunakan dalam dua arti, yaitu arti sempit dan arti luas. Dalam arti sempit, rechtstheorie menunjukkan lapisan antara dogmatik hukum dan filsafat hukum (ilmu eksplanasi hukum dengan karakter interdisipliner). Sedang-kan rechtstheorie dalam arti luas sama dengan rechtswetenschap dalam arti luas.

Di Inggris, digunakan istilah Jurisprudence yang berasal dari bahasa latin (iuris : hukum – prudential : berpengetahuan yang tepat, ini berarti “knowledge of law”, “skill in law”, “knowledge and sound judgment”). Jurisprudence is the knowledge of things divine and human, the knowledge of the just and unjust.

Istilah jurisprudence kadang-kadang dipertukarkan dengan istilah Legal Theory dalam arti luas.

Menurut MDA Freeman, Jurisprudence involves the study of general theoretical questions about the nature of laws and legal system, about the relationship of law to justice and morality and about the social nature of law.

Menurut Ian McLeod, Legal theory in a wide sense, to include not only an examination of the nature of law, but also the nature of right and justice, and the relationship between law and morality.

Hal ini berbeda dengan istilah Science of law. Menurut MDA Freeman “science, however, is concerned with empiricaly obser-vable facts and events. Science of law berbeda dengan Jurisprudence yang berarti penjelajahan ilmiah ilmu hukum sebagai ilmu empiris. Sedangkan Jurisprudence sebagai ilmu praktis normatif yang melahirkan para juris. Jurisprudence lebih cenderung diartikan sebagai ilmu hukum (normatif) = makna rechtstheorie dalam arti luas= rechtswetenschap dalam arti luas.
