Der Staat kann die rechtlichen Koordinaten der Energiewirtschaft festlegen und dabei auch grundrechts- bzw. eigentumsrelevante Eingriffe vornehmen. Er muss allerdings die eigentumsverfassungsrechtlichen Vorgaben beachten, die die höchstrichterliche Rechtsprechung und die Staatsrechtswissenschaft in dogmatischer Feinarbeit entwickelt haben. Das gilt gerade im Zeitalter der Energiewende, in dem der Staat nicht selten das Eigentum von Privatpersonen oder Unternehmen belastet, um energie- oder klimapolitische Maßnahmen durchzusetzen. Der vorliegende Band will diese Thematik aufgreifen und dabei die Querschnittsfunktion des Eigentumsgrundrechts sowie dessen Einfluss auf das Recht der Energiewirtschaft verdeutlichen. The state can determine the legal coordinates of the energy sector and at the same time, intervene in themes related to fundamental and property rights. However, the state must respect the property laws developed by the judiciary and jurisdiction in a dogmatic and detailed manner. This especially applies to the era of energy transition where the state not seldom burdens the property of private persons or companies in order to implement energy or climate political actions. The present volume addresses this issue and simultaneously demonstrates the intersection of fundamental property rights and its effects on the rights of the energy sector.
